Welcome to Petsofy. The terms "we", "us" and "our" refer to Petsofy store, a pet products and services business based in Kuwait. Petsofy operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Petsofy is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you confirm that you are of legal age in Kuwait, and that you consent to any minor dependents using the Services on devices you own or manage.
To use the Services, including browsing our store or purchasing products or services, you may be asked to provide information such as your name, email address, phone number, and delivery address. You confirm that all information you provide is correct, current and complete.
You are responsible for keeping your account details secure and for all activity on your account. You may not transfer or sell your account to another person.
SECTION 2 — OUR PRODUCTS AND SERVICES
We make every effort to represent our products and services accurately. Please note that colours and product appearance may differ from how they appear on your screen depending on your device.
Product descriptions, ingredients and nutritional information are provided by our suppliers and manufacturers. We are not responsible for changes made by manufacturers to their own formulations or packaging.
Product descriptions are subject to change at any time without notice. We may discontinue any product at any time and may limit quantities available to any customer.
SECTION 3 — PET SERVICES (GROOMING AND PET HOTEL)
Grooming appointments and pet hotel stays are booked through our website or directly with our team.
All pets must be registered before a pet hotel stay. Registration is completed at our store at drop-off.
Pet hotel drop-off and pick-up take place during store hours, 10:00 AM to 10:00 PM. Each stay is counted per day.
We reserve the right to decline a service booking if we believe a pet is unwell, aggressive, or otherwise unsuitable for the service, in the interest of the safety of the animal, other animals in our care, and our staff.
You confirm that any information you provide about your pet's health, behaviour and vaccination status is accurate and complete.
SECTION 4 — ORDERS
When you place an order, you are making an offer to purchase. Petsofy may accept or decline your order at its discretion. Your order is not accepted until we confirm it. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests once an order is accepted. If we do not accept, change, or cancel an order, we will contact you using the email address or phone number provided.
Your purchases are subject to return or exchange in accordance with our Refund Policy.
SECTION 5 — PRICES AND PAYMENT
All prices are shown in Kuwaiti Dinar (KWD). Prices, discounts and promotions may change without notice. The price charged is the price in effect at the time the order is placed and will be confirmed in your order confirmation.
Unless stated otherwise, posted prices do not include delivery charges. Delivery charges depend on your area and are shown at checkout.
Prices online may differ from prices in our physical store. Where a promotion has its own terms and those conflict with these Terms, the promotion terms apply.
You confirm that any payment information you provide is true and correct, and that you are authorised to use the payment method.
SECTION 6 — DELIVERY
Delivery is covered by our Shipping Policy. Delivery times are estimates and are not guaranteed. We are not liable for delays caused by events outside our control.
SECTION 7 — INTELLECTUAL PROPERTY
Our Services, including all trademarks, text, images, graphics, video and audio, and their design, selection and arrangement, are owned by Petsofy, its affiliates or licensors, and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, republish or transmit any material from the Services without our prior written consent.
The Petsofy name, logo and product names are trademarks of Petsofy. You must not use them without our prior written permission. All other names and logos on the Services are the trademarks of their respective owners.

The Services may contain links to websites operated by third parties, and may give you access to tools provided by third parties. We do not control these and are not responsible for their content or accuracy. Any use of third-party tools is at your own risk, and you should review the relevant third party's own terms.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
Petsofy is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Petsofy. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sale between you and Petsofy, including any injury, damage or loss resulting from purchased products and services. You release Shopify and its affiliates from all claims arising from your transactions with Petsofy.
SECTION 10 — PRIVACY
All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read it.
SECTION 11 — REVIEWS AND FEEDBACK
If you submit reviews, suggestions, feedback or other content, you grant us a royalty-free licence to use, reproduce, publish and display that content for any purpose, including commercial use.
You confirm that your content does not infringe the rights of any third party and does not contain unlawful, abusive or offensive material. We may, but are not obliged to, remove content we consider unsuitable.

We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.
Product information, including ingredients and nutritional content, is provided by manufacturers. Nothing on the Services is veterinary advice. Please consult a veterinarian regarding your pet's health, and before using any therapeutic or prescription diet.
SECTION 16 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, Petsofy, our partners, directors, employees, agents and suppliers shall not be liable for any indirect, incidental, special or consequential damages of any kind arising from your use of the Services or any products purchased through the Services.
SECTION 17 — INDEMNIFICATION
You agree to indemnify and hold harmless Petsofy, Shopify, and our affiliates, officers, employees and service providers from any losses, damages or claims arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your use of the Services.
SECTION 18 — SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force.
SECTION 19 — ENTIRE AGREEMENT
These Terms of Service and any policies posted by us constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreements or communications.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms of Service and any separate agreements under which we provide you Services are governed by and construed in accordance with the laws of the State of Kuwait. You and Petsofy agree to submit to the jurisdiction of the courts of Kuwait.

You can review the most current version of these Terms of Service at any time on this page. We reserve the right to update or replace any part of these Terms by posting changes to our website. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
